Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of Tunefork, including its website, accounts, public profiles, shared voting links, workspaces, subscriptions, and related services.

Please read these Terms before creating an account or purchasing a paid plan.

1. Service Provider

Tunefork is operated under the trading name Tunefork by:

The service is currently operated as a non-registered activity under Polish law (działalność nierejestrowana).

In these Terms, “Tunefork”, “we”, “us”, and “our” refer to Francis Apalenis operating under the Tunefork trading name.

2. Scope and Acceptance

These Terms apply to every person who visits, creates an account with, purchases, accesses, or uses Tunefork.

By creating an account, accepting these Terms during registration or checkout, or using Tunefork, you enter into an agreement with Tunefork and agree to comply with these Terms.

If you use Tunefork on behalf of a team, studio, label, school, company, or other organisation, you confirm that you are authorised to act on its behalf and bind it to these Terms.

Mandatory rights granted to consumers under applicable law remain unaffected.

Tunefork is a digital service designed primarily for music creators, producers, DJs, studios, labels, schools, teams, and related users.

Tunefork may allow Users to:

Listener feedback is subjective. Tunefork does not guarantee that any vote, comment, ranking, test result, analytics output, or recommendation will produce artistic, commercial, financial, release, or other success.

5. Early-Stage Service

Tunefork is an early-stage digital service. Features may be tested, modified, redesigned, replaced, restricted, suspended, or discontinued as the service develops.

Tunefork may occasionally experience:

Users must not use Tunefork as their only storage location for important files or project information. Users are responsible for maintaining independent backup copies of audio files, artwork, feedback, analytics, and other important materials.

The early-stage nature of the service does not limit mandatory consumer rights, valid payment obligations, or Tunefork’s obligations under applicable law.

6. Eligibility

You may use Tunefork only if:

Tunefork is not intended for independent use by children under 16. A person under 16 may use the service only where such use is lawfully authorised and supervised by a parent, legal guardian, school, or other responsible organisation.

A person purchasing a Paid Plan must have legal capacity and authority to make the payment.

To use Tunefork, you generally need:

The maximum size of a single uploaded audio file is 50 MB.

Tunefork may change supported formats, technical requirements, or file limits for legitimate security, compatibility, performance, operational, or product-development reasons. Material changes affecting a Paid Plan are subject to Section 29.

8. Account Registration and Security

Some Tunefork features require an Account, email verification, authentication link, invitation, or another access method.

You are responsible for:

Tunefork may temporarily restrict an Account where reasonably necessary to investigate suspected account compromise, fraud, unlawful conduct, payment abuse, or security risks.

9. Formation of the Agreement

9.1 Free plan

An agreement for use of the Free plan is formed when a User creates an Account, accepts these Terms, and receives access to the service.

9.2 Paid Plans

An agreement for a Paid Plan is formed when:

  1. the User selects the plan;
  2. the applicable price, billing period, and main plan features are displayed;
  3. the User accepts these Terms and the Privacy Policy;
  4. the User confirms an order that clearly involves an obligation to pay;
  5. payment is successfully authorised or confirmed.

The confirmation of purchase may be sent by email or made available through the Account.

9.3 Payment processor

Payments are processed through Stripe. The Stripe account used by Tunefork is maintained as an individual account in Poland.

Stripe processes payment information but does not replace Tunefork as the service provider or contractual counterparty unless a checkout page expressly states otherwise.

Tunefork does not receive or store full payment-card details.

10. Plans

10.1 Free

The Free plan costs €0.

A Free Account receives a lifetime allowance to create up to four Fork Links in total.

Each Fork Link created under the Free plan permanently uses one of the four available Free link slots. A slot is not restored when a Fork Link is deactivated, expired, hidden, or deleted. The allowance does not reset monthly or at any other time.

A Free Account may therefore create no more than four Fork Links during the lifetime of that Account unless the User purchases a Paid Plan or Tunefork expressly grants additional capacity.

Creating multiple Accounts to obtain additional Free allowances is prohibited.

Other Free-plan features and limitations are displayed on the pricing page or in the service interface.

10.2 Producer

The Producer plan currently costs €4.99 per month.

It is intended for one independent producer or professional User and includes:

10.3 Public Producer Profile

A Producer Profile may allow the User to publish:

The User decides whether to activate the profile and which information or Fork Links to make public.

Information published on a Producer Profile is publicly accessible and may be copied, indexed, shared, recorded, or republished by third parties. Tunefork cannot guarantee confidentiality of information intentionally made public by the User.

10.4 Team

The Team plan currently costs €16.99 per month.

It is intended for teams, studios, labels, and similar groups and includes:

A Team customer requiring more than five seats must contact info@tunefork.co. Additional seats may be provided on separately agreed terms and may require an additional fee.

No standard additional-seat price applies until Tunefork publishes or individually agrees one.

10.5 Current plan information

The main characteristics, price, billing period, and included features of a Paid Plan are shown before purchase.

If a marketing page conflicts with the final checkout summary, the checkout summary and these Terms apply, subject to mandatory consumer rights.

11. Prices and Payment

Paid Plans are billed in advance.

Unless otherwise stated at checkout:

Tunefork may issue invoices, receipts, or payment confirmations electronically.

Users are responsible for providing valid and current payment information.

Tunefork does not add undisclosed mandatory charges after the order is confirmed.

12. Subscription Lifecycle

12.1 Automatic renewal

A Paid Plan renews automatically at the end of each billing period unless cancelled before the renewal date.

The renewal payment is charged using the payment method stored with Stripe.

The applicable renewal date and amount may be displayed in the Account, Stripe customer portal, checkout confirmation, invoice, or payment email.

12.2 Ordinary cancellation

A User may cancel future renewal by:

Ordinary cancellation takes effect at the end of the current paid billing period.

The User keeps access to the Paid Plan until that date. After that date, the Account is downgraded to Free.

Except where required by law or expressly agreed by Tunefork, ordinary cancellation does not create a right to a prorated refund for the unused part of the current billing period.

12.3 Upgrades

An upgrade normally takes effect immediately.

Where the upgrade increases the subscription price during an existing billing period, Stripe may calculate and charge a prorated amount for the remainder of that period.

The amount payable must be displayed or otherwise communicated before the upgrade is confirmed.

An upgrade that requires an immediate payment may be applied only after that payment succeeds.

12.4 Downgrades

A downgrade normally takes effect at the end of the current paid billing period.

After the downgrade, features, seats, active projects, profiles, or other usage exceeding the new plan’s limits may become unavailable.

The User is responsible for exporting or reducing affected Content before the downgrade becomes effective.

12.5 Failed payments

If a recurring payment fails:

  1. Stripe or Tunefork may retry the payment during a three-day grace period;
  2. the User may receive one or more payment-failure notifications;
  3. the User should update the payment method or complete the outstanding payment;
  4. Paid Plan access may remain temporarily available during the grace period;
  5. if payment remains unsuccessful after three days, the Account may be downgraded to Free and Paid Plan features may be restricted.

A later successful payment may restore the Paid Plan, but Tunefork does not guarantee restoration of Content already deleted under the applicable retention rules.

12.6 Payment disputes and reversals

Tunefork may restrict Paid Plan access where a payment is reversed, charged back, disputed, refunded, or reasonably suspected to be fraudulent.

The User remains responsible for valid unpaid amounts unless the payment obligation has been lawfully cancelled or refunded.

13. Fair Use and Anti-Abuse Policy

Producer and Team provide substantially relaxed usage restrictions but do not provide an unconditional right to unlimited technical consumption.

They are intended for genuine individual, professional, studio, label, or team use of Tunefork as a music comparison, voting, feedback, and collaboration service.

Tunefork may determine, in its reasonable and good-faith discretion, whether activity falls outside normal use. Tunefork may consider the nature, pattern, purpose, frequency, automation, technical impact, and operational impact of the activity.

Prohibited or abusive use includes:

Tunefork is not required to publish internal abuse-detection methods, thresholds, security rules, or infrastructure limits where disclosure could enable circumvention, manipulation, or harm.

Where reasonably appropriate, Tunefork may:

  1. contact the User;
  2. issue a warning;
  3. request a change in usage;
  4. apply temporary restrictions;
  5. deactivate affected links or Content;
  6. require a different or individually agreed plan;
  7. suspend the Account;
  8. terminate access in serious or repeated cases.

Tunefork may act immediately where reasonably necessary to address fraud, security threats, illegal Content, payment abuse, manipulation, service disruption, or material harm.

A User may challenge an anti-abuse decision by emailing info@tunefork.co.

Mandatory consumer rights remain unaffected.

14. User Content and Ownership

Users retain ownership of User Content and any intellectual-property rights they lawfully hold.

By uploading or submitting User Content, the User grants Tunefork a limited, non-exclusive, worldwide licence to host, copy, store, process, encode, convert, transmit, display, and analyse that Content only as reasonably necessary to:

This licence does not transfer ownership of User Content to Tunefork.

The licence ends when the relevant Content is permanently deleted, except to the limited extent that temporary backup copies, security records, billing records, legal records, or evidence of abuse must be retained.

15. Audio Privacy and Use

Uploaded audio remains User Content.

Tunefork will not:

Audio may be processed by Tunefork and its service providers only as reasonably necessary to provide, maintain, secure, and support the service.

Tunefork applies reasonable technical and organisational measures intended to protect User Content. No online system can guarantee absolute security, and Users should not upload Content where the remaining risk is unacceptable to them.

The handling of personal data is described in the Tunefork Privacy Policy.

16. Responsibility for User Content

The User is responsible for all User Content submitted through their Account.

The User confirms that they have all rights, licences, permissions, consents, and clearances necessary to:

Users must not upload or share Content that:

Tunefork may restrict or remove Content where reasonably necessary to comply with law, protect rights, secure the service, investigate a complaint, or enforce these Terms.

17. Listener Feedback, Votes, and Analytics

Listener feedback is subjective and may be inaccurate, incomplete, inconsistent, biased, offensive, manipulated, or statistically unrepresentative.

Tunefork does not independently verify the artistic, statistical, commercial, legal, or business value of comments, votes, test results, or analytics.

Users are responsible for how they interpret and use feedback.

Tunefork may filter, hide, remove, or restrict feedback that appears unlawful, abusive, spam-like, manipulated, or inconsistent with these Terms.

18. Shared Links and Confidentiality

The User is responsible for deciding who receives a Fork Link and whether a Fork Link is public, unlisted, private, or displayed on a Producer Profile.

Unless an access-control feature is expressly enabled, any person who obtains a Fork Link may be able to view or interact with the relevant Fork.

Tunefork cannot guarantee that a link or the Content behind it will remain confidential if a recipient forwards, copies, records, publishes, indexes, downloads, or otherwise discloses it.

Users should not upload unreleased, confidential, commercially sensitive, or embargoed Content unless they understand and accept the risks of link-based sharing.

19. Team Workspaces and Member Data

Each Team member retains ownership of Content that the member uploads or creates.

Joining a Team Workspace does not transfer ownership of a member’s Content or private Account data to the Team owner.

A Team owner or administrator may access only:

A Team owner does not receive access to a member’s private Account-level Content that the member has not shared into the Team Workspace.

A Team owner or administrator may:

A Team owner’s administrative ability to remove or delete shared Content does not give the owner intellectual-property ownership of that Content.

A Team member may request a copy of data and Content attributable to that member by emailing info@tunefork.co before the data is deleted.

Users are responsible for obtaining copies of important Content before leaving a Team, being removed from a Team, deleting an Account, or allowing a Team Workspace to be deleted.

20. Data Export

A User may request an export or copy of eligible Account data and User Content by emailing info@tunefork.co.

The request should be sent from the email address associated with the Account or otherwise include sufficient information to verify identity and entitlement.

Tunefork will provide eligible data without undue delay and, where required by law, free of charge in a commonly used format.

Some Content may not be exportable where:

Users should submit export requests before deleting their Account.

Once Content has been permanently deleted, Tunefork cannot provide or restore it.

21. Account Deletion and Retention

A User may request Account deletion through the Account interface, where available, or by emailing info@tunefork.co.

After a confirmed deletion request:

Certain limited records may be retained for longer where reasonably necessary or legally required, including:

Backup systems are maintained for resilience and are not intended as a customer archive. Tunefork does not guarantee restoration of an individual Account or Content from backup after deletion has been requested.

Cancelling a subscription does not automatically delete the Account or its Content.

Deleting an Account does not automatically cancel payment obligations already validly incurred. Users should cancel an active Paid Plan before or together with an Account-deletion request.

22. Withdrawal and Full-Refund Policy

22.1 Fourteen-day right

A Consumer who concludes a Paid Plan online generally has the right to withdraw from the contract within 14 calendar days from the date the paid contract is concluded, without giving a reason.

Tunefork additionally grants all first-time Paid Plan purchasers a contractual right to request a full refund of the initial Paid Plan payment if the request is sent within 14 calendar days after the initial purchase.

This additional full-refund policy does not automatically apply to renewals, later billing periods, additional seats, separately agreed services, or purchases made after a previous refunded subscription, unless required by law or expressly approved by Tunefork.

22.2 How to withdraw

Withdrawal must be submitted by email to:

The message should clearly state that the User wishes to withdraw from the Paid Plan and should identify:

The User does not need to give a reason.

22.3 Effect of withdrawal

After a valid withdrawal:

The User must stop using Paid Plan functionality after withdrawal.

This Section does not limit any more favourable mandatory right available under applicable law.

23. Complaints and Digital-Service Conformity

Complaints, billing complaints, and notices that the service does not conform to the agreement must be sent to:

A complaint should, where possible, include:

Tunefork will respond within five business days after receiving the complaint.

Depending on the circumstances and applicable law, available remedies may include:

Tunefork is responsible for conformity of the digital service with the agreement as required by applicable law.

Mandatory complaint and consumer remedies remain unaffected.

24. Acceptable Use

Tunefork uses or may use third-party service providers for purposes including:

Third-party providers may process information as described in the Privacy Policy and may have their own terms and privacy notices.

Tunefork is not responsible for independent third-party services outside its reasonable control. This does not exclude obligations that Tunefork cannot lawfully exclude, including obligations relating to the selection and management of processors.

26. Intellectual Property of Tunefork

The Tunefork name, brand, website, interface, software, code, workflows, documentation, visual design, and underlying technology belong to Francis Apalenis, Tunefork, or their licensors.

Subject to these Terms, Tunefork grants the User a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose.

Users must not copy, sell, lease, sublicense, distribute, reproduce, modify, or commercially exploit Tunefork’s protected materials except where expressly permitted by Tunefork or mandatory law.

Nothing in this Section gives Tunefork ownership of User Content.

27. Rights Complaints and Takedown Requests

A person who believes that Content available through Tunefork infringes their rights may email info@tunefork.co.

The notice should include:

Tunefork may request additional information and may temporarily restrict the affected Content while reviewing the complaint.

Tunefork may remove or disable access to Content where reasonably necessary to comply with law or protect legitimate rights.

28. Price Changes

Tunefork may change Paid Plan prices for legitimate legal, tax, operational, technical, market, security, or product-development reasons.

A price increase will not apply retroactively to a completed billing period.

For an existing subscription, Tunefork will normally provide at least 30 days’ advance notice by email or through the Account before a higher price takes effect.

The new price will apply from the renewal date stated in the notice.

The User may cancel the Paid Plan before the new price becomes effective.

Where a price change requires the User’s express consent under applicable law, continued use alone will not replace that consent.

29. Service Changes

Tunefork may modify the service for legitimate reasons including:

Changes necessary to maintain security or conformity may be introduced without advance notice where delay would create a material risk.

Other non-material changes may take effect when published.

If a change materially and negatively affects a Consumer’s access to or use of a continuously supplied Paid Plan, Tunefork will provide appropriate advance notice on a durable medium, normally by email.

Where required by Polish law, the Consumer may terminate the affected contract without charge within 30 days from the later of:

This termination right does not apply where Tunefork allows the Consumer to continue using the unchanged and conforming version without additional cost.

30. Changes to These Terms and Privacy Policy

Tunefork may update these Terms for legitimate legal, regulatory, security, technical, operational, payment, or product-development reasons.

The updated version will be published with a revised “Last updated” date.

Non-material changes may take effect when published.

For material changes affecting an existing Paid Plan, Tunefork will provide reasonable advance notice by email or through the Account, unless immediate implementation is reasonably required by law, security concerns, fraud prevention, or prevention of abuse.

Material changes to the Privacy Policy will normally be notified by email at least 10 days before taking effect, unless a shorter period is reasonably necessary because of law, security, fraud prevention, or an urgent service change.

Users are responsible for keeping their Account email address current.

Continued use after a properly notified change may constitute acceptance where permitted by law. Where applicable law requires express consent, continued use alone will not replace that consent.

31. Suspension and Termination

Tunefork may suspend, restrict, downgrade, or terminate access where reasonably necessary because of:

Where reasonably possible, Tunefork will provide notice and an opportunity to correct the breach.

Tunefork may act immediately where delay could result in unlawful activity, security risk, service disruption, fraud, manipulation, or material harm.

Termination does not remove payment obligations already validly incurred.

A User may terminate use of the Free plan at any time by ceasing use and deleting the Account.

32. Disclaimers

Subject to mandatory consumer rights, Tunefork is provided on an “as is” and “as available” basis.

Tunefork does not guarantee that:

Users must maintain independent backup copies of important Content.

Nothing in this Section excludes Tunefork’s statutory responsibility for conformity of a digital service or any other responsibility that cannot lawfully be excluded.

33. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful.

In particular, these Terms do not limit mandatory consumer rights or liability arising from intentional misconduct, fraud, or other liability that cannot legally be excluded.

To the maximum extent permitted by law, Tunefork is not responsible for indirect or consequential loss resulting from:

For Users acting wholly in the course of business, Tunefork’s aggregate liability arising from the service will not exceed the total fees paid by that User to Tunefork during the 12 months preceding the event giving rise to the claim, except where such limitation is prohibited by law.

34. Force Majeure

Tunefork is not responsible for delay or failure caused by events outside its reasonable control, including:

Tunefork will take reasonable steps to reduce the effects of such an event where practicable.

Mandatory consumer rights remain unaffected.

35. Governing Law and Disputes

These Terms are governed by Polish law.

Consumers retain mandatory protections provided by Polish law and any other mandatory consumer protections that cannot be excluded under the law applicable to them.

Consumers may bring claims before courts having jurisdiction under applicable law.

For Users acting wholly in the course of business, disputes arising from these Terms or Tunefork will be submitted to the courts having jurisdiction for Warsaw, Poland, unless mandatory law provides otherwise.

Before starting formal proceedings, Users are encouraged to contact info@tunefork.co so that the matter can be reviewed.

36. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

A failure by Tunefork to enforce a provision immediately does not waive the right to enforce it later.

Users may not assign or transfer their agreement or Account without Tunefork’s written consent.

Tunefork may transfer the operation of the service and its contractual rights and obligations to a formal legal entity or successor business, provided that mandatory rights are preserved and Users receive notice where required.

Section headings are included for convenience and do not affect interpretation.

The current version of these Terms is the version published on Tunefork’s website, subject to any version separately confirmed to a User on a durable medium.
